Educational Data & FERPA Compliance

Michelle’s Special Education Advocacy operates in alignment with the Family Educational Rights and Privacy Act (FERPA) and relevant state education laws.

When working with school teams, educators, or families, any shared data involving a student’s name, disability classification, IEP goals, behavioral information, or related educational records is considered protected educational information.

We do not collect, store, or share any personally identifiable educational data without written permission from the parent or legal guardian or the agency holding educational authority, and only for the purpose of fulfilling contracted services.

Educational data shared through forms, email, or collaboration platforms is stored securely, encrypted when possible, and never sold, published, or reused beyond its intended purpose.

Licensees of the Stimulation Profile System are contractually required to uphold these same privacy protections when using any materials with student-specific information.

Terms and Conditions

1. General Use

By accessing or using this website, purchasing services, submitting forms, or accessing protected content, you agree to the terms outlined herein. These Terms and Conditions apply to all site visitors, clients, licensees, and subscribers.

2. Intellectual Property

All materials on this site, including the Stimulation Profile System, digital downloads, branded documents, logos, graphics, guides, PDFs, forms, and proprietary frameworks are the intellectual property of Michelle Velazquez and are protected by U.S. Copyright Law.

No content may be copied, redistributed, republished, rebranded, modified, or shared without explicit written permission from the owner.

Licensed users may access and use approved materials for internal professional purposes only, under the terms of their signed agreement. All rights are reserved.

3. Service Modifications

Michelle’s Special Education Advocacy reserves the right to update or improve services and digital content to reflect current best practices. Major updates will be communicated to licensees at least 30 days in advance. Updates are included during the active license period.

4. Educational Use Disclaimer

The content provided is intended to support families, schools, and service providers in understanding and responding to student needs. It is not a substitute for legal advice or medical evaluations.

All educational decisions, IEP development, and placement outcomes remain the responsibility of the appropriate school team and/or parent/legal guardian.

5. FERPA & Confidentiality

Michelle’s Special Education Advocacy is committed to protecting all student-related information in accordance with FERPA and applicable privacy laws.

Any educational information shared via forms, meetings, or during service is treated as confidential and will never be sold, published, or used for unauthorized purposes. Users submitting student data confirm they are legally permitted to do so.

6. Limitation of Liability

By using this site or participating in services, you agree to assume all associated risks and waive any claims for damages against Michelle Velazquez, her company, team members, or collaborators.

The company makes no guarantees regarding specific student outcomes, program success, or legal interpretations.

7. Third-Party Services

8. Payments & Refunds

All payments for digital resources, coaching, or licensed materials are non-refundable once access is granted or services begin. Custom payment plans and bulk pricing must be approved in writing.

9. Dispute Resolution

This agreement shall be governed by the laws of the State of Michigan and all applicable federal laws. In the event of a dispute, both parties agree to seek resolution in writing prior to pursuing legal action.

Appointment Scheduling Terms & Conditions

These Terms & Conditions apply to all appointments scheduled with Michelle’s Special Education Advocacy, including consultations booked by parents/guardians and school districts or professional teams. By scheduling an appointment, you acknowledge that you have read, understood, and agree to the following.

1. Role, Scope, and Non-Legal Services

  • Michelle Velazquez is not an attorney and does not provide legal advice, legal representation, or legal services.

  • All information, coaching, and materials shared through appointments are for general informational and educational purposes only.

  • The goal of these services is to help you better understand the special education process, options, and documentation so that you can make your own informed decisions with your educational team, legal counsel, or district leadership as appropriate.

  • Nothing shared in any appointment should be interpreted as:

    • Legal advice

    • A guarantee of a specific outcome

    • A replacement for your own professional, medical, or legal judgment

You remain fully responsible for all decisions made for your child, student, or district.

2. Services Covered by Scheduled Appointments

Depending on the appointment type you select, services may include:

  • Review of documents and data (IEPs, evaluations, progress reports, emails)

  • Phone or virtual consultations

  • Drafting or editing parent input statements, advocacy letters, or meeting prep notes

  • Suggestions related to program design, accommodations, goals, or data collection

  • Guidance on questions to ask your IEP/504 team

  • For districts: exploratory calls regarding professional development, the Stimulation Profile System, or collaboration options

Participation in IEP meetings (virtual or in-person), professional development (PD), and any district licensing or contracted services are not included in standard scheduled consultations unless specifically:

  • Listed in the appointment description, and/or

  • Covered by a separate written agreement or contract.

3. Appointment Types: Parents vs. School Districts

To keep roles and expectations clear, you will see distinct appointment types in the scheduling system.

A. Parent/Guardian Appointments

These appointments are designed for parents, guardians, or adult students seeking individual support. By booking a parent-focused appointment, you agree that:

  • You are the parent, legal guardian, or authorized decision-maker for the student discussed.

  • All materials shared with you are for personal use only. You may bring them to your IEP/504 meetings, but you may not present them as district documents or redistribute them as formal tools for school staff.

  • Michelle Velazquez does not speak on your behalf in legal filings and does not represent you in due process, complaints, or court actions.

B. School District / Professional Team Appointments

These appointments are for superintendents, directors, administrators, districts, or school-based teams. By booking a district/professional appointment, you agree that:

  • The purpose of the call is exploratory and/or consultative, not a formal contract.

  • Any ongoing work with staff, district-wide implementation, or PD requires a separate written agreement, contract, or licensing terms, approved by both parties.

  • Materials shared during or after the meeting are for internal review only unless explicit written permission is granted for broader use.

4. Booking, Payment, and Session Length

  • Appointment length, format (phone or virtual), and cost will be listed within each appointment type in the scheduler.

  • Complimentary consultations: If noted as free, the call is limited to the listed time and purpose (for example, exploration of fit, basic next steps, or district discovery call).

  • Paid sessions: Payment is typically due at the time of booking unless otherwise arranged (for example, district invoice or purchase order).

  • By submitting payment, you agree that services may begin immediately and acknowledge that Michelle Velazquez is not providing legal services.

5. Cancellations, Rescheduling, and No-Show Policy

You may need to adjust your appointment, and the scheduling time is reserved specifically for you.

  • Rescheduling:

    • You may reschedule your appointment up to 4 hours before the scheduled start time through the scheduling system (or as otherwise instructed in your confirmation email).

  • Cancellations:

    • Cancellations made at least 4 hours before the appointment may be rescheduled to a later date.

    • Cancellations made less than 4 hours before the appointment may be treated as a late cancellation and may not be eligible for a refund, at Michelle Velazquez’s discretion.

  • No-Shows:

    • If you do not attend your appointment and do not communicate prior to the start time, this is considered a no-show.

    • No-shows are not refundable and may require a new booking and payment to reschedule.

  • Late Arrivals:

    • If you join late or do not answer the phone call, the session will still end at the original scheduled time. One more attempt will be made 10 minutes later as a good-faith effort to get in touch with you.

    • If you are more than 15 minutes late without notice, the appointment may be treated as a no-show.

Districts with separate written agreements may have specific cancellation/payment terms outlined in their contract; those terms will control in case of conflict.

6. Communication and Boundaries

  • Most communication regarding your appointment (confirmation, reminders, links) will occur via email through the scheduling system. Text message reminders may occur with the consent of the client. 

  • Coaching and consulting services are not emergency or crisis services. If you are experiencing a crisis or safety concern for a student, contact emergency services, the school, or appropriate professionals immediately.

  • Response times for emails outside scheduled sessions may vary; email is not a guaranteed real-time support channel without a contract in place as a formal client. 

7. Confidentiality and Records

  • Information you share during appointments is treated as confidential within the limits of the law.

  • Michelle Velazquez maintains all confidentiality with clients and school districts during all communication during such consults. 

  • You are responsible for maintaining your own copies of documents, meeting notes, and email records.

For districts, discussions must comply with FERPA and local privacy requirements and are ultimately the district’s responsibility.

8. Intellectual Property and Use of Materials

  • All templates, tools, forms, and written materials provided by Michelle Velazquez are copyrighted intellectual property of Michelle’s Special Education Advocacy, unless otherwise noted.

  • For parents/guardians: materials are provided for personal use only to support your own advocacy and home/school communication. They may not be altered, branded, or redistributed as your own product or as district tools.

  • For districts: any use of materials for internal staff training, PD, or district-wide implementation must be covered by a separate licensing or professional development agreement.

  • You may not reproduce, sell, redistribute, or present any materials as your own intellectual property.

9. Responsibility and Limitations of Liability

  • You understand and agree that you are responsible for how you use the information, tools, and strategies provided.

  • Michelle Velazquez is not responsible for:

    • Decisions made by you, your IEP/504 team, or your district

    • Outcomes of meetings, services, or educational placements

    • Actions taken (or not taken) by school staff, administrators, or agencies

To the fullest extent permitted by law, any liability arising from the use of these services is limited to the amount paid for the specific appointment or package related to the claim.

10. Consent to These Terms

By scheduling an appointment, checking any “I agree” box, and/or submitting payment, you confirm that:

  1. You have read and understand these Terms & Conditions.

  2. You understand that Michelle Velazquez is not providing legal advice or legal representation.

  3. You agree to be bound by these Terms & Conditions for all appointments booked through the scheduling system.
